Father of Minor Accused in Pune Porsche Crash Detained by Police

The Pune Police have detained the father of the minor accused in Pune Pune Porsche crash case. Two persons have lost their lives. Vishal Agarwal, the father of the teen has been detained from the Sambhajinagar area of Aurangabad district in Maharashtra this morning, according to the Commissioner of Police, Pune, Amitesh Kumar. 

The father of the accused and the bar that served liquor to the juvenile accused are to be processed under Section 75 ( Cruelty to the child) and Section 77 ( giving a child any intoxicating liquor or any narcotic drug or tobacco substances) under the Juveline Justice Act.

Tragic Incident 

During the early hours of Sunday, two individuals, including a young woman, lost their lives after a luxury car Porsche collided with their motorcycle near Kalyani Nagar in Pune. The incident took place at 3: 15 AM. The driver of the Porsche was identified as a minor, he was arrested after the accident. Later, he was granted bail by the Juveline Justice Board with conditions aimed at rehabilitation and awareness. 

Juvenile Justice Board’s strict action

The conditions for the accused were imposed by the Juveline Justice Board. The accused should work with the traffic police of Yerwada for 15 days, after that he has to write an essay on the accident. Concerning the incident the accused should get treatment from the doctor to help him quit drinking and should take psychiatric counselling and submit a report. 

IPC Sections imposed 

The Police had said that the minor has been charged with rash and negligent driving and causing harm by endangering life or personal safety under the Indian Penal Code sections 304A (Causing death by negligence), 279 ( Rash driving or riding on Public Way), 337 (Causing hurt by rash or negligent driving), 338 (Causing grievous hurt by act of life or personal safety of others), and 427 (Mischief causing damage to the amount of fifty rupees) along with relevant sections of the Maharashtra Motor Vehicle act.

Police Commissioner’s Statement 

Pune Commissioner of Police (CP) Amitesh Kumar said,  “They have moved two applications in this case, it is a heinous crime. They have requested that they should be allowed to try the accused as an adult in the case, under the provisions of section 15 of the Jiveline Justice Act. In the other application, they have sought permission to keep the accused in a remand home till the decision of the first application is taken. 

“Unfortunately, both of our applications were rejected. Today, we have applied to a higher court and hope we will get a favourable order. We are exploring all legal remedies to use sections 2 and 15 of the Juvenile Justice Act”, he added. 

Further, the Police have moved the applications, seeking permission to try the juvenile accused as an adult. He also added that the application had been rejected by the lower court, following which police moved to the high court. 

The police will take appropriate action irrespective of which “economic strata”, the case will be handled with “full transparency”.
